Obama wants to send it to the legislative branch who is meant to create law not the judicial who is meant to enforce otherwise if there is a regime change it will be easily flipped.
I think Obama is not sucking as hard as everyone thinks although I have some personal issues I wish he would sort out.
I think it is the wrong time to ferment such unhappiness with our choice as he has done a great many things right and more since any sitting president since Roosevelt. There are a tremendous number of literal minded idiots who are being driven by there own or other peoples bank accounts and not by any notion of common good, public health or otherwise.
The GOP and the Tea baggers are banking on liberal apathy and wishy washy fickle people of independent typically un-engaged status who become dissatisfied if their exact agendas are not being addressed.
